Welcome to Smartmax AI. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.
Smartmax AI provides digital services including but not limited to web design, web development, SEO strategies, and content refinement. The specific scope of work, deliverables, and timelines will be defined in a separate proposal or agreement for each project.
For One-Off Builds: Upon full payment of all fees, the Client is granted full ownership of the final website code and design assets. Smartmax AI retains the right to use the work for portfolio and marketing purposes.
For Partner Models (Monthly): Smartmax AI retains ownership of the code, design, and digital assets. The Client is granted a non-exclusive license to use the website while the subscription is active. Buyout options are available after a 12-month tenure.
Payments: Invoices are due upon receipt unless otherwise specified. We reserve the right to suspend services for late payments.
Cancellations: Monthly subscriptions may be cancelled with 30 days' written notice. For one-off projects, deposits are non-refundable once work has commenced.
To ensure the success of the project, the Client agrees to provide necessary assets (images, text, credentials) in a timely manner. Delays in providing these assets may result in project timeline extensions.
Smartmax AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of our services.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Smartmax AI operates, without regard to its conflict of law provisions.
